1. Who these terms are with

This website, yoursongs.ai, is operated by YourSongs LLC, a Delaware limited liability company. By using the site you agree to these terms. If you do not agree, please do not use the site.

2. Who can use this site

This site and the early access list are for adults. You must be 18 or older to use this site, to join the early access list, and to agree to these terms. If you are under 18, please do not use the site or give us your email address.

3. What this site is

The site describes a service we are building and lets you join a list to be told when it opens. The service is not available yet. No song can be ordered, bought or delivered through this site today.

Everything on the page describing how the service will work is a description of our current intention. Features may change before launch.

4. The early access offer

If you join the early access list, we intend to give you 50% off your first song when the service opens. So that there is no confusion about what that does and does not mean:

• It is an invitation, not a binding offer, and it does not create a contract between us. No contract exists until the service opens, you place an order, and we accept it under the terms in force at that time.
• It applies to one song per person, on a first purchase.
• It has no cash value and cannot be exchanged for cash.
• It cannot be combined with another offer unless we say so.
• We may change or withdraw it, and we may set a reasonable deadline for using it. If we do, we will tell the people on the list by email before it takes effect.
• It is void where prohibited by law.

Joining the list does not reserve you a place, guarantee you access, or oblige us to launch.

5. No launch date, and no promise of one

We have deliberately not published a launch date. Nothing on this site should be read as a commitment to launch at a particular time, on particular terms, at a particular price, or at all. Statements about what the service will do are forward-looking and may turn out to be wrong.

6. Joining the list, and email

You may only submit an email address that is yours, or one you are authorized to give us. By submitting it you consent to us emailing you about the launch.

You can withdraw that consent at any time, including before we have sent you anything, using the remove me from the list page. Once we begin sending emails, every one will also carry a working unsubscribe link.

How we handle your address is set out in our Privacy Notice, which forms part of these terms.

7. Acceptable use

Please do not:

• submit an email address belonging to someone else without their permission;
• submit entries automatically, in bulk, or through a script or bot;
• attempt to interfere with, overload, probe or gain unauthorized access to the site;
• scrape or systematically copy the site; or
• use the site for anything unlawful.

We may remove any submission and block access if we reasonably believe this section has been broken.

8. Our content and our marks

The text, layout, design and images on this site belong to YourSongs LLC or are used with permission, and are protected by copyright and other laws. YourSongs™ and the YourSongs seal are our trademarks. You may view and share the page, but you may not copy, reproduce or adapt it for your own commercial purposes without our written permission.

Names of other companies and services mentioned on this site, including Spotify, Apple Music and Amazon, are the trademarks of their respective owners. Mentioning them does not mean they endorse us or are affiliated with us.

9. Other sites

If this site ever links to a site we do not run, we are not responsible for its content or its privacy practices.

10. No warranty

The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the fullest extent the law allows, YourSongs LLC and its members, officers and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of your use of this site. Our total liability arising out of or relating to this site and these terms will not exceed one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of sections 9 and 10 may not apply to you. Nothing in these terms excludes liability that cannot lawfully be excluded.

12. Changes to these terms

We may update these terms. The effective date at the top will change when we do, and the updated version applies from the moment it is posted. If you keep using the site after that, you accept the updated terms.

13. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or to this website will be brought in the state or federal courts located in Massachusetts, and you and we each consent to the personal jurisdiction of those courts.

If the law of the state or country where you live gives you rights or protections that cannot be overridden by agreement, those rights are unaffected by this section.

14. General

If any part of these terms is held unenforceable, the rest continues to apply. Our not enforcing a provision is not a waiver of it. These terms, together with the Privacy Notice, are the entire agreement between you and us about your use of this website.
